*In This Issue: An "Insane" Court Ruling Against The Scouts;
Next, A Transsexual Scout Executive?*
Dear Reader,
There have been two disconcerting legal assaults on Scouting in the past
few weeks, both of them in California. One was the federal district
court ruling against the Scouts by a notorious "activist judge" in the
case brought by the American Civil Liberties Union (ACLU) over the
Scouts' longtime lease of land for a camp in San Diego's Balboa Park.
The judge ruled that the Boy Scouts are a "religious organization" and
that the lease is unconstitutional. It is pretty clear from the wording
of the ruling, as well as its conclusion, that this judge had first made
up his mind to punish the Scouts and then found an apparent legal basis
to do it.
National news commentator Bill O'Reilly called the ruling "insane" in a
segment on his number one rated cable news show, "The O'Reilly Factor."
We could not agree more. We summarize his comments in this issue of the
newsletter and provide a link to a transcript of his entire "Talking
Points Memo."
To help you better understand this bizarre ruling, we are also providing
a brief legal analysis by Peter Ferrara, who is Chief Counsel for the
Scouting Legal Defense Fund as well as the Counsel to our sponsoring
organization, the American Civil Rights Union (ACRU). The ACRU was
organized specifically to fight this kind of whackiness perpetrated by
the ACLU and we will be supporting the Scouts in their appeal of this
outrageous decision.
Peter, by the way, also appeared on the MSNBC cable news show,
"Scarborough Country," defending the Scouts in a debate on this ruling.
A summary and link to a transcript of that program is also included in
this newsletter.
California Governor Gray Davis probably has set the stage for another
legal assault on Scouting when he signed AB 196, a bill that levies
fines up to $150,000 against the Scouts or any other non-religious,
non-profit organization or commercial business that refuses to hire a
transsexual or cross-dresser. Several specific attempts to exempt the
Scouts and similar organizations failed.
This law will probably spawn litigation that probably likely will have
to go all the way to the U.S. Supreme Court, where the Scouts
undoubtedly will win. After all, the court found that the Scouts could
exclude openly homosexual men from serving as scoutmasters because they
were not appropriate role models to instill the values of Scouting into
boys. Certainly, that right applies even more clearly to transsexuals
and cross-dressers. The sad thing is that resources that could have gone
to helping boys would be wasted in the litigation to redefine this
obvious right.
Thanks for all you continue to do to defend Scouting. As events continue
to demonstrate, we certainly have our work cut out for us.
Sincerely,
Robert B. Carleson

*NEWS FROM THE SCOUTING LEGAL DEFENSE FUND*
*Legal Analysis: The Scouts Lose Round One In San Diego*
**
In the latest case arising from the assault of the American Civil
Liberties Union (ACLU) on the Boy Scouts, /Barnes Wallace v. Boy Scouts
of America/, San Diego Federal District Court Judge Napoleon Jones
begins his opinion by saying, "[T]he Boy Scouts displays intolerance
towards individuals who identify themselves as homosexual, agnostic, or
atheist by denying membership to or revoking the membership of gay and
nonbelieving individuals."
The judge continued, saying that the Boy Scouts maintain an
"anti-homosexual, anti-agnostic, and anti-atheist stance", and that "it
is clear that the Boy Scouts of America's strongly held, private,
discriminatory beliefs are at odds with values requiring tolerance and
inclusion in the public realm."
But the judge could have said the same about any Catholic church or
Catholic organization, which hold the same views on homosexuality and a
belief in God as the Scouts. Ditto any Protestant church or organization
that refuses to include openly practicing homosexuals, or atheists, as
priests, bishops, or adult leaders. Ditto any Mormon or Islamic church
or organization.
Indeed, the same could be said about any American who believes in
traditional moral values and organizes to promote and teach them, which
is the essence of the Boy Scouts. Does the intemperate language of Judge
Jones reflect the attitude of the U.S government towards Americans who
hold such values? If the ACLU gets its way, the answer will be "yes."
This case is about two leases to the Boy Scouts of America of parkland
in San Diego. The city first leased an 18 acre parcel of Balboa Park to
the San Diego Scouts in 1957 for a nominal annual fee. The Scouts have
invested several million dollars in this property since then to build
and maintain a first class youth campground site. In 1987, the city
similarly leased a one half acre parcel to the San Diego scouts in
Mission Bay Park. The Scouts have invested millions in that site as well
to build a first class youth aquatic center.
Both sites are open to the public for a nominal fee on a first-come,
first-served, reservation basis, and are heavily used by non-Scout youth
groups. The Scouts have now invested more in these properties than their
sale value on the open market, according to the ACLU's own expert witnesses.
The ACLU sued the city on behalf of a lesbian couple and an atheist
couple, both with Scout age sons, even though neither the sons nor the
parents would be excluded from either facility. Ludicrously, Judge Jones
held that the leases amounted to unconstitutional aid to religion.
But the Scouts receive no aid from the leases. Rather, the leases are a
vehicle for the Scouts to provide millions and millions of dollars in
charitable aid to the city and the general public. Without the Scouts,
the taxpayers would have to pay millions for such facilities.
The Scouting Legal Defense Fund will be working to reverse this
ridiculously biased decision, which will otherwise serve as a precedent
for similar suits across the country. We will file briefs on appeal and
in any further proceedings before Judge Jones in Federal District Court.
If we lose on appeal before the Ninth Circuit, we will help the Scouts
take the case to the United States Supreme Court.

Scouting Legal Defense Fund Chief Counsel Peter Ferrara was a guest on
the August 5th edition of MSNBC's "Scarborough Country" cable news
program. The show featured a debate on the recent federal court decision
that found that the lease with the City of San Diego for a Scout camp in
Balboa Park was unconstitutional. He appeared with Howard Mezner, a
representative of Scouting for All, a tiny group based in California
that is agitating to change the national Scout position on homosexuals.
Ferrara aggressively defended the Scouts' lease arrangement, pointing
out numerous misstatements and mistakes Mezner made, noting that he was

*WHAT IS HAPPENING TO SCOUTING AROUND THE COUNTRY*
. *Federal Judge Rules Against Scouts' Lease, Labeling Them A Religious
Group*
**
Federal District Judge Napoleon Jones, Jr. has ruled against the Scouts
and the City of San Diego in the lawsuit brought by the American Civil
Liberties Union (ACLU) challenging the city's lease of land in Balboa
Park for a Scout camp. Jones cited "overwhelming and uncontradicted
evidence" that the Scouts are a religious organization and that the
lease arrangement is an unconstitutional violation of the separation of
church and state. The Scouts' current lease expires in 2007 and they
have requested a 25 year extension before investing several million
dollars in capital improvements to the camp. No decision has yet been
made on an appeal. Article here

. *California Law Would Require Scouts To Hire Transsexuals,
Cross-Dressers*
California Governor Gray Davis has signed legislation that makes it
illegal for businesses and non-profit organizations like the Boy Scouts
to refuse to hire transsexuals and cross-dressers. The legislation adds
the term "perceived gender or _expression" to California's Fair
Employment and Housing Act and is intended to protect individuals "whose
perceived gender characteristics are different from those traditionally
associated with the individual's sex at birth." Only religious
organizations are exempted from the law and offending organizations can
be fined up to $150,000. During consideration in the legislature,
opponents of the legislation repeatedly and specifically cited the
impact it could have on the Scouts and other non-profits as well as on
businesses such as religious bookstores, but the legislation passed
anyway. Press release here

. *Scouts Pull Charter Of Venture Crew For Violating Policy On Homosexuals*
The charter of Sebastapol, California-based Venture Crew 488 was not
renewed because the lead advisor attached a copy of a non-discrimination
policy to the renewal application that violates national Scout policy.
The policy statement stated that the crew "will not discriminate in
accepting membership applications from youth or adults on the basis
of...sexual orientation." Lead advisor Bev Buswell admitted that she
disagreed with the national policy and expected that attaching the
policy would provoke a response from the local council. Ralph Voelker,
Redwoods Empire Scout Council executive, noted that "the policies of the
Boy Scouts of America are not pick and choose" and that local units have
no leeway in whether to adhere to national policies. Article here

*SOME THOUGHTFUL COMMENTARY ON SCOUTING*
In "The ACLU Strikes Again," Bill O'Reilly in his "Talking Points"
commentary blasts Federal District Judge Napoleon Jones' "insane ruling"
in the Balboa Park Scout camp case that the Scouts are a religious
organization and that the city's lease with them is unconstitutional.
The number one rated cable news show host noted that the ruling is
"simply dangerous and should be condemned by all fair-minded Americans.
When judges have the power to subvert the Constitution, rather than
uphold it, we are all in major trouble. And that's the situation we are
facing with the ACLU again leading the way." Full commentary here
