*In This Issue: The Scouts Lose A Major Case, California Judges
Compromise, Comparing The Scouts To The Taliban, and Hackers and
Bookburners.
*
Dear Reader,
The Scouts suffered a major defeat recently when a federal appeals court
unanimously upheld the lower court ruling that Connecticut could
discriminate against the Scouts because of their position on
homosexuals. The state had eliminated the Scouts as an eligible charity
to receive funding through the state employee payroll deduction program.
The Scouting Legal Defense Fund filed an /amicus/ brief supporting the
Scouts in this case and we will continue to support them if they choose
to appeal the decision.
However, some good news on the legal front came out of California. The
California Supreme Court rejected demands by some of the state's liberal
bar associations to force state judges to sever any ties with the
Scouts. They claimed that such an association violates the ethics
standards barring judges from membership in any group that discriminates
on the basis of "sexual orientation," even though non-profit groups are
specifically exempted. The court wisely decided to simply require judges
to disclose any association with the Scouts and possibly recuse
themselves in certain cases involving homosexuals.
We also highlight in this issue a column taking the Philadelphia Daily
News to task for comparing the Scouts to the Taliban. In an editorial,
the paper professes to be "disturbed by similarities between the Afghan
fundamentalist group and the homophobic American shapers of youth."
Normally, such an absurd position would not even justify a response,
even when published in a newspaper in a major city. But, as the
escalating attacks on the Scouts in recent years have shown, these are
not normal times.
Finally, our "techie" people tell us that our Web site recently survived
a determined attack by computer hackers. Those who try to hack issue
sites like ours exhibit the same mentality as those who feel they must
burn books or otherwise limit the flow of ideas and information to the
people. Among other things, it shows that they do not have confidence
that their ideas cannot stand close examination and the application of
reason, logic and common sense. For those attacking the Scouts, this is
absolutely the case.
These kinds of hack attacks are also a compliment, if only in a
backhanded sort of way. If the Defense Fund and our Web site were not
making a difference in the fight to defend Scouting, they would not
bother. So, hackers, thanks for the compliment.
As always, we are proud to join so many of you in defending Scouting.
Sincerely,
Robert B. Carleson

*NEWS FROM THE SCOUTING LEGAL DEFENSE FUND
*
*Scouts Lose A Round In Connecticut Discrimination Case*
In a unanimous decision, a three judge panel of the federal 2nd Circuit
Court of Appeals, upheld the lower court decision against the Scouts in
the case, Boy Scouts v. Wyman, dealing with discrimination against the
Scouts by State of Connecticut's charity check off program. Under this
program, state employees can check off charities that they want a
portion of their salary sent to each month. The state expelled the Boy
Scouts from participation in this program on the grounds that the Scouts
discriminate against gays by excluding them from adult leadership
positions.
The Boy Scouts sued the state on the grounds that this exclusion
violated their Constitutional rights to freedom of speech and freedom of
association. The District Court of Connecticut ruled against them, and
the Boy Scouts appealed to the Second Circuit U.S. Court of Appeals. The
American Civil Rights Union (ACRU) filed a brief /amicus curiae/ on
behalf of the Scouting Legal Defense Fund (a project of the ACRU)
supporting the Boy Scouts, arguing that a long line of cases holds that
the government cannot penalize a party for exercising its
constitutionally protected rights, as the state of Connecticut did to
the Boy Scouts in this case.
The Scouts have not yet decided whether to appeal this decision to the
full circuit and on to the Supreme Court.

*WHAT IS HAPPENING TO SCOUTING AROUND THE COUNTRY
*
*--Scouts Suffer Setback In Connecticut Case*
In a major setback for Scouting, the federal 2nd Circuit Court of
Appeals has unanimously upheld a district court ruling that the State of
Connecticut can discriminate against the Scouts because of their
position on excluding homosexual men from serving as scoutmasters. The
Connecticut Rivers Council and the national Scouts sued the state's
employee charitable giving campaign over excluding the Scouts from the
list of charities to which state employees can contribute through the
state payroll deduction program. The Scouts maintain that the state's
action violates their constitutional rights. The Scouts have not yet
made a decision on an appeal. Article here.

*--California Allows Judges To Continue Association With Scouts, But...*
The California Supreme Court has ruled that judges in California can
continue to be associated with the Scouts as leaders or volunteers, but
if they are they must disclose that fact and possibly even recuse
themselves from cases involving homosexuals. The court acted in response
to complaints by a number of local bar associations urging the court to
re-interpret the ethics standards for judges in a way that would require
judges to sever any ties with the Scouts because of the Scout's position
on homosexuality. These standards generally prohibit a judge from being
associated with groups that, among other things, discriminate on the
basis of "sexual orientation." There is a specific exemption in the
ethics requirements for participation in non-profit youth groups.

*--Funding Fallout Over Council Decision*
In continued fallout from the decision of the Philidelphia-based Cradle
of Liberty Council's to publicly reject the national Scouting policy on
homosexuals and then subsequently being forced by the national Scout
office to reverse that policy, a major contributor, Pew Charitable
Trust, has announced that it is withholding a $100,000 grant from the
council. The charity had been funding the council for 50 years. The
local United Way, which was expected to contribute about $400,000, is
also considering whether to cut off all funding to the Scouts over the
policy on homosexuals. Article here
<http://www.philly.com/mld/inquirer/news/local/6162554.htm>.
*--And Even More Fallout For Pennsylvania Council*
Further fallout from the attempt by the Pennsylvania Cradle of Liberty
Council's effort to renounce the national Scout policy on homosexuals
came in the form of new scrutiny by the Philadelphia City Council of an
agreement to allow the council to use a half acre parcel of city-owned
downtown property rent free "in perpetuity." The grant, made in 1928, is
the site of the council's headquarters building. Some councilmen have
complained that the terms of the agreement violate the city's ordinance
against discrimination on the basis of "sexual orientation." Article

*AND SOME THOUGHTFUL COMMENTARY ON SCOUTING...
*
In "The Difference Between The Boy Scouts and the Taliban," columnist
Hans Zieger takes the Philadelphia Daily News to task for editorializing
"Given the latest Boy Scout flap, we can't help being disturbed by
similarities between the Afghan fundamentalist group and the homophobic
American shapers of youth." Zieger, who is also an Eagle Scout, answers
that question: "What's the difference between the Boy Scouts and the
Taliban? Trustworthy. Loyal. Helpful. Friendly. Courteous. Kind.
Obedient. Cheerful. Thrifty. Brave. Clean. Reverent. Of such is the
defeat of the Taliban and all of the other great evils of our time."
