*F**rom the Editor: The Defense Fund Helping Berkeley Sea
Scouts, We Get Valuable Feedback from You*
            Dear Reader;
As explained in more detail below, we are becoming involved
in the case against the City of Berkeley in California for
penalizing the Berkeley Sea Scouts because of the Scouts
position on excluding openly homosexual men from serving as
            scoutmasters.
We filed a "friend of the court" letter with the California
Supreme Court seeking their review of the case. While we
think the action of the city is clearly unconstitutional
based on federal court decisions in similar cases, two lower
state courts have upheld the city.
The California Supreme Court recently agreed to hear this
case and we expect to file a friend of the court brief on
behalf of the Sea Scouts. If the state court rules against
the Scouts, the case will almost certainly go to federal
court. It is clear that we will have to expect this kind of
litigation attempting to bring pressure on the Scouts to
change their position on homosexuals and be prepared to help
            defend them.
I also want to thank you to all of you who responded to our
recent reader survey. We now have a much better idea of who
you are and how we can provide the most useful information
and services to you through this newsletter. Overall, you,
our readers, are generally pleased with the current format
and features of the newsletter and we certainly appreciate
the supportive comments and positive feedback. We will be
making some changes as a result of the survey, though
nothing major. For those who are interested, we have
summarized the results of the survey below.
Thanks again for all that so many of you are doing to help
            defend Scouting.
            Sincerely,
            Robert B. Carleson
            Editor
P.S. You can help us spread the word by forwarding this
newsletter on to others who will help defend Scouting and by
making a contribution to support our efforts.
*NEWS FROM THE SCOUTING LEGAL DEFENSE FUND*
*The Defense Fund Supports Berkeley Sea Scouts*
The American Civil Rights Union (ACRU), the sponsoring
organization of the Scouting Legal Defense Fund, has filed a
"friend of the court" letter urging the California Supreme
Court to review the lower court decision in the Berkeley Sea
Scout case, /Eugene Evans, et al v. City of Berkeley/. The
suit was filed after the city rescinded a six decade policy
of giving the Sea Scouts free berthing privileges at the
city marina because the city disagrees with the Scouts
policy on homosexuals. The state appeals court has upheld a
lower court decision in favor of the city. The state
Supreme Court has subsequently agreed to review the case.
Robert Carleson, an Eagle Scout and former Quartermaster Sea
Scout who is the Chairman of the ACRU, explained that "The
American Civil Rights Union is committed to defending all
rights enumerated in the Bill of Rights, not just those that
might be politically correct for a time or fit a particular
ideology." The action of the City of Berkeley is an
"unprecedented attack on the Sea Scouts for the simple act
of associating with the Boy Scouts," he said, and clearly
            appears unconstitutional.
Carleson pointed out that unless the higher court agrees to
review the appeals court decision "important issues of law
will remain unsettled with regard to the restriction of the
free speech and association rights of many private and
religious associations by local government." Click here
            <https://www.defendscouting.com/seascouts.html> for
additional background on this case and the ACRU/Scouting
            Legal Defense Fund involvement.
            *Reader Survey Summary*
The average reader of the Defend Scouting Newsletter is
male, between the ages of 40 and 60, who is a past or
present scouting volunteer. This profile, revealed in our
recent reader survey is pretty close to what we expected.
The survey did reveal some surprising things, however. Less
than 30% of readers responding identified themselves as
former Scouts. We had thought that segment of subscribers
            would be larger.
We were also surprised by the percentage of readers
identifying themselves as past or present Scouting
professionals, about 4%. Since the newsletter goes out to a
fairly sizable number of people each month, we expected
fewer respondents identifying themselves in this category.
The biggest surprise of all, however, was the number of
people forwarding the newsletter on to others on their
e-mail list. About six out of ten respondents reported that
they sent it on to at least one other person and a very high
percentage of those reported sending it on to at least six
others. We had no idea that this was happening on this scale.
"News From The Scouting Legal Defense Fund" was the most
useful feature of the newsletter for respondents. The
section we often include on thoughtful commentary on
Scouting was decidedly the least useful. As a result, we
are discontinuing that feature unless we identify something
that is truly outstanding or newsworthy. A surprising
number of respondents also said they wanted us to provide
more detail in their favorite feature, so we will be doing
            that in the future.

Portland, Oregon, United Way Likely Cutting Scout Funding*
The Willamette-Coliumbia United Way, serving the Portland,
Oregon, area has adopted a "non-discrimination policy" that
will likely cut off funding to the Cascade Pacific Scout
Council in 2004 because of the Scouts position on
homosexuals. While the local United Way claims that the
change in policy is not directed at the Scouts, a spokesman
for the local Scout Council noted that "it seems we are the
only group excluded...I do think it is about us." Article

The Cedar Rapids, Iowa-based Hawkeye Scout Council has cut
its ties with the Johnson County United Way because of
continuing pressure on the council over the scouts stands on
religion and homosexuals. In explaining the action, the
council noted that it had devoted a large amount of staff
time and energy trying to resolve the problem but that the
United Way, in turn, was under pressure from the University
of Iowa. The university is demanding enforcement of a
strict non-discrimination policy as a requirement for
allowing the local United Way to solicit contributions from
            university employees. No article available.

While the action of a local United Way cutting off funding
to a Scout Council always makes local news, how the affected
council tries to deal with the loss of funds often is not as
well reported. An exception is how the Bay-Lakes Council

funding from the Oshkosh United Way last spring. Article

California Legislation Could Force Scouts To Hire
            Cross-dressers, Transsexuals*
A bill levying fines of up to $150,000 on businesses and
non-profit organizations such as the Scouts which reject job
applicants because they are cross-dressers or transsexuals
has narrowly passed the California Assembly. Introduced by
a state legislator identified as a homosexual, the bill
would change California's definition of "gender" in its
non-discrimination statute to "identity, appearance, or
behavior, whether or not that identity, appearance, or
behavior is different from that traditionally associated
with the victim's sex at birth." In the discussion of the
impact of the bill the Scouts were frequently mentioned as
one of those that would have difficulties if it became law.
