*In This Issue: An Attack On Scouting From Within And Our Litigation Update*
Dear Reader,
The effort reported in this issue by the Philadelphia-area Cradle of
Liberty Council to defy Scouting policy on homosexuals reminds us that
not all of the attacks on Scouting come from outside the Scouting
family. By a unanimous vote of its board, the council added "sexual
orientation" to its non-discrimination policy, effectively repudiating
the national policy.
What is most disturbing here is that this action by the council clearly
was intended to generate the maximum negative publicity for Scouting.
The vote came just a few weeks before the council was to host the
Scout's National Annual Meeting, knowing full well that the press
reports of that meeting would prominently feature this act of rebellion
by the host council. The council's action also encouraged protestors at
the meeting, including some local scouts, who were then prominently
featured by the media, adding to the negative publicity.
To its credit, the national scout office moved swiftly and decisively in
dealing with the Cradle of Liberty Council. It threatened to revoke the
council's charter and appoint a new board if the council refused to
adhere to the national policy. Shortly thereafter, the council issued a
statement that it was back in compliance. Chief Scouter Roy Williams
attached that statement to a memo sent to scout executives nationwide
reminding them that "As a condition of their charter, no local council
is permitted to depart from membership policies."
While the Cradle of Liberty Council's actions were particularly
egregious and blatant, the root cause is a common one. The local United
Way was bringing increasing pressure on the council to break with the
national policy as a condition even for continued funding for the
Learning for Life program. This is yet another example of a growing
trend across the country of a local United Way putting political
correctness ahead of what is good for the community it is supposed to
serve.
Also in this issue is an update on the litigation we are involved with
in defense of Scouting. While we will report any new cases or major
developments in the monthly newsletter, the wheels of justice grind
slowly enough that we plan on doing a comprehensive litigation update
like this one only about every three or four months. .
Thanks for all that so many of you are doing to defend Scouting and
please continue to let us know about any attacks on Scouting in your area.
Sincerely,
Robert B. Carleson

*NEWS FROM THE SCOUTING LEGAL DEFENSE FUND*
*SLDF Litigation Update*
This is a description of the litigation in which the Defense Fund is
involved and the current status of each case. (The Scouting Legal
Defense Fund is a project sponsored by the American Civil Rights Union
(ACRU), which represents the Defense Fund in these cases.)
*Barnes-Wallace v. City of San Diego.* The San Diego Boy Scout Council
holds a long term lease from the city on certain park facilities. The
Boy Scouts have spent huge sums over the years building and maintaining
improvements in the leased parks, including camping facilities,
playgrounds, and a boating marina. The parks and the Scout improvements
are open to the general public and anyone can reserve time to use the
Scout improvements as well as the rest of the park. In this case, the
American Civil Liberties Union (ACLU) is suing the city claiming that
the lease amounts to a subsidy to the Boy Scouts in violation of state
anti-discrimination law. The Supreme Court has held that the Boy Scouts
have a Constitutional right to refuse to appoint or retain openly gay
adult Scout leaders. But the ACLU argues that does not mean that a
government entity can subsidize such conduct, which is discriminatory in
the eyes of the ACLU.
The Boy Scouts argue that the city cannot punish them for exercising a
constitutionally protected right by terminating their contract, or by
denying them the same right to contract with the city that anyone else
has. They also argue that despite the minimal rental payment under the
lease the city is not subsidizing the Scouts, the Scouts are subsidizing
the city with all of the park improvements and maintenance the Scouts
pay for.
Both sides have moved for summary judgment without trial, and are
awaiting the Judge's ruling. The American Civil Rights Union is
supporting the Boy Scouts in this case.
*Boy Scouts of America v. Wyman.* In this case, the state of Connecticut
runs a charity check off program where state employees can check off
charities that they want a portion of their salary sent to each month.
The state expelled the Boy Scouts from participation in this program on
the grounds that the Scouts discriminate against gays by excluding them
from adult leadership positions.
The Boy Scouts sued the state on the grounds that this exclusion
violated their Constitutional rights to freedom of speech and freedom of
association. The District Court of Connecticut ruled against them, and
the Boy Scouts appealed to the Second Circuit U.S. Court of Appeals.
Briefs have been filed and oral argument has been held and the parties
are awaiting the Court's decision. The American Civil Rights Union filed
a brief /amicus curiae/ supporting the Boy Scouts, arguing that a long
line of cases holds that the government cannot penalize a party for
exercising its constitutionally protected rights, as the state of
Connecticut did to the Boy Scouts in this case.
*Powell v. Portland Public School District. *In this case, the American
Civil Liberties Union (ACLU) sued the Portland Public School District on
behalf of an atheist student arguing that the school district violated
the student's constitutional rights by allowing the Boy Scouts to
distribute literature at the school promoting the Scout program. The
lower state courts in Oregon have ruled in favor of the Scouts and the
ACLU is now asking the Oregon state Supreme Court to take the case. If
the Court does take it, the American Civil Rights Union will file a
brief /amicus curiae/ supporting the Scouts.

*WHAT IS HAPPENING TO SCOUTING AROUND THE COUNTRY*
*--Local Council Defies National Policy On Homosexuality *
The Philadelphia-area based Cradle of Liberty Council in May voted to
include "sexual orientation" in its non-discrimination policy. The
unanimous vote by the council's board was widely viewed as an act of
direct defiance of the national Scout policy. "We disagree with the
national stance, and we are not comfortable with the stated national
policy," council board chairman David Lipson, Jr. explained. The vote
came less than a month before the Philadelphia council was to host the
Scout's National Annual Meeting in that city.

*--Rebellious Scout Council Brought Back Into Line, Expels Homosexual Scout*
Just a month after taking action to defy the national policy on
homosexuals, the Philadelphia-area Cradle of Liberty Council bowed to
the threat by the national Scout office that it would revoke the
council's charter and appoint a new council board. In a statement issued
less than a month after the unanimous vote by its board to add "sexual
orientation" to the council's non-discrimination policy, the council
issued a new policy statement that "an individual who declares himself
to be a homosexual would not be permitted to join Scouting." The council
also expelled an openly homosexual Scout.

*--Montana Council Reaffirms National Policy On Homosexuals
*
In one example of the fallout from the effort by the Philadelphia-based
Cradle of Liberty Council's abortive effort to defy the national policy
on homosexuals, the Montana Council for Boy Scouts publicly reaffirmed
it support of the policy. "We believe that we have the right to
determine our membership. Membership is a right, not a privilege, and
it's limited to those willing to espouse the values of the Boy Scouts of
America," said Ray Chase, Scout Executive. .

*--Davis, California Pressures Scouts To Change Policy*
The Davis, California City Council recently voted to send a second
letter to the national Scout office urging the organization to change
its policy on homosexuals. The action came on a request from the Davis
Human Rights Commission, which claimed that a number of local Scouts and
leaders had approached the commission asking for city support in their
efforts to change the policy. "The Boy Scouts have the right to
discriminate," Cecilia Greenwald, chair of the Commission admitted.
"We're asking them to change."

*SOME THOUGHTFUL COMMENTARY ON SCOUTING...*
--In "The End of the Boy Scouts in Philadelphia" columnist Hans Zeiger
concludes that "Philadephia's Cradle of Liberty Council self-destructed
last week." Zeiger, an 18 year old Eagle Scout, Assistant Scoutmaster
and a columnist for the Seattle Times, calls on scout families in
Philadelphia and across the country to "fight back and defend the Boy
Scouts from further damage." He points out that "We must be reminded
that the Boy Scouts are not an intolerant, homophobic, racist,
anti-Semitic bunch." Rather, he says, "The Scouts have always taught
tolerance and have been at the forefront of celebrating diversity." But
he notes, "Scouting has also taught the difference between right and
wrong, between honor and indecency, between justice and perversity."
