*In this issue: The Defense Fund Updates The Watch List;
California Does It To The Scouts Again.*
Dear Reader:
We have recently completed our annual update of the United Way Watch
List, our listing of local United Way organizations around the country
that have cut off funding their local Scout councils or appear to be in
the process of doing so.
Unfortunately, the problem of local United Way organizations withholding
funding to put pressure on the Scouts over their policies on homosexuals
and atheists is a growing one. In the past year, we have identified 8
more local United Ways that have taken this action. That brings to 68
out of the roughly 1400 local United Ways nationwide that have done so,
at a cost of millions of dollars in lost funding to the Scouts. The
primary goal of the Watch List is to help local councils replace this
lost funding by publicizing the actions of these local United Ways to
potential contributors. We also hope the adverse publicity that results
from being on the Watch List will discourage other local United Ways
that may be contemplating cutting off their local Scouts.
The Scouts' policy on homosexuals and atheists is resulting in
additional official harassment in California. As we report in this
issue, the California State Senate has now joined the State Assembly in
adopting Resolution 89 criticizing the Scouts' policy and declaring that
it is "contrary to the policy of California." It goes without saying
that it is inappropriate for the legislature to go out of its way to
criticize the Scouts. But since they have taken it upon themselves to do
so, it must also be understood that what the California legislature is
really saying is that the constitutional protection of freedom of
association which the United States Supreme Court upheld as a right of
the Scouts is "contrary to the policy of California." The sad thing, it
has been pointed out, is that even if those voting for the resolution
understood that this is what they were actually doing, it probably would
not have made any difference to most of them. For them, political
correctness will always trump the Constitution.
This is just another illustration of how serious the fight is that all
of us must continue to wage to defend Scouting and protect this critical
institution that is so important to the future of our nation. Thanks to
all of you who are actively engaged in that good fight.
Sincerely,
Robert B. Carleson

*NEWS FROM THE SCOUTING LEGAL DEFENSE FUND*
The Scouting Legal Defense Fund has completed its annual update and
review of the United Way Watch List
<https://www.defendscouting.com/thewatch.html>, the most comprehensive
publicly available listing of local United Way organizations that have
cut off funding their local Scout councils or appear to be in the
process of doing so. Presently, 68 of the approximately 1400 local
United Ways across the country are on the Watch List, including some of
the largest in the country. The actions taken by these United Ways cost
the Scouts millions of dollars annually in lost funding.
"The primary purpose of the United Way Watch List has always been to
help protect United Way contributions to local Scout councils around the
country," notes Robert Carleson, Chairman of the American Civil Rights
Union, the organization sponsoring the Scouting Legal Defense Fund. "By
publicizing which local United Ways have cut off their local Scout
councils, we want potential contributors to know that if they want to
support the Scouts they must do more than simply make a general
contribution to that United Way. They must either contribute to their
Scout council directly or at least specifically designate the Scouts as
the recipient of any United Way contribution they might still choose to
make."
The Watch List feature on the Web site explains the process by which
local United Way organizations are pressuring local Scout councils. It
also provides easy to follow instructions on how people can contribute
directly to their local council.
"We also hope that by publicizing the actions of local United Ways that
cut off the Scouts, and the drop in contributions that frequently
follows, we can help discourage other United Ways that may be
contemplating taking similar action," Carleson said. The Defense Fund is
gearing up a publicity campaign to publicize the Watch List to coincide
with many local United Ways fall fundraising campaigns.

*WHAT IS HAPPENING TO SCOUTING AROUND THE COUNTRY*
*California Senate Criticizes Scouts*
. Following the lead of the California Assembly last spring, the
California State Senate by a 22-15 vote passed Resolution 89 which
declares that the policy of the Boy Scouts on atheists and homosexuals
is "discriminatory" and "contrary to the policy of the State of
California. The 80-member California Assembly had passed the resolution
by a 43-2 vote. Democratic Los Angeles Assemblywoman Jackie Goldberg, an
admitted lesbian, is the original sponsor of the resolution. Among other
things, it demands that the Scouts accept boys and leaders "without
discriminating on the basis of sexual orientation or religious belief."
Article is available here
<http://www.worldnetdaily.com/news/article.asp?ARTICLE_ID=34379>.
*Article Tallies Attacks On Scouting*
. A recent article in the Boston Globe on the status of Scouting across
the country concludes that "the Boy Scouts now are newly embroiled in a
culture war with local governments and charities over gay rights,
religion, and morality." In tallying the battlegrounds of this cultural
war, the paper cites actions taken against the Scouts by local United
Way organizations across the country, the state of Connecticut, cities
like Berkeley, California, and Philadelphia and by the courts in issuing
such decisions as the recent ruling against the Scouts in the lawsuit
challenging their lease of a portion of Balboa Park in San Diego.

*Scouts Appeal San Diego Decision, City Declines To Join For Now*
. The Scouts have appealed the recent decision of federal District Court
Judge Napoleon Jones, Jr. that continuing the lease of a portion of San
Diego's Balboa Park to the local Desert Pacific Scout Council is an
unconstitutional endorsement of a "religious organization" by the city.
The city has declined for now to join the Scouts in the appeal, though
it has not ruled out doing so in the future. Because the judges ruling
is still preliminary, the city has decided that appealing the decision
at this time would be premature. The American Civil Liberties Union
filed the suit. Article is available here
<http://www.signonsandiego.com/news/metro/20030904-9999_6m4scouts.html>.
*Does Fox Poll Show A Decline In Public Support For Scout Policy?*
. A recent national opinion poll appears to show a surprising decline in
public support for the policies of organizations like the Scouts that
prohibit homosexuals or lesbians from serving in leadership and advisory
positions. When the pollsters asked the question "Do you think
organizations should screen out gay and lesbian adults from serving in
jobs that allow them to be alone with children, such as scout troop
leader or teacher?" only 34% agreed, 54% disagreed and 12% were unsure.
This is such a significant departure from all previous polls that show
strong public support for the Scouts' position that it has led some to
question whether the poorly worded question confused some respondents.
Other results of the poll, The poll was taken primarily to test public
opinion on the issue of same sex marriage, and the results of that
portion were in line with a number of other recent polls showing strong
public opposition to legalizing that. Article is available here
<http://www.foxnews.com/story/0,2933,95753,00.html>.
*AND SOME THOUGHTFUL COMMENTARY ON SCOUTING...*
. Seattle Times columnist Hans Zeiger poses the question "Will Arnold
Support The Scouts" in a column that ties the recent action by the
California State Senate criticizing the Scouts to the California recall
election. He notes that at the time he was writing, only Republican
State Senator Tom McClintock among the 135 candidates hoping to replace
Governor Gray Davis had criticized the resolution and come out in
support of the Scouts. McClintock was one of only 15 state senators
voting against the resolution. Zieger notes that frontrunner Arnold
Schwarznegger "promised to side with the Boy Scouts. But the passage of
this resolution will be Arnold's test. If he really supports the Boy
Scouts, now is the time for him to speak out against this outrageous
declaration of hatred and moral relativism by the California
legislature. Complete column is available here
